If you have purchased a license to use Blizzard’s Diablo III Interactive Game (“Diablo”) and you reside in North America, then any license to use the virtual goods (“Loot”) you purchase and sell through the Auction House is provided to you by Blizzard Entertainment, Inc., who will be your contracting party hereunder.
6B. WINNING AN AUCTION.
Your bid will be the “Winning Bid” for an auction, if
(i) you bid the “Purchase Now Price”; or
(ii) your bid for the Loot is the highest bid when the auction expires.
Once Blizzard notifies someone that he or she won an auction, Blizzard will purchase the license to use the Loot from the seller and then sell a license to use the Loot to the winner of the auction. Additionally, Blizzard may, in its sole discretion, sell the Loot to the winner of the auction, regardless of whether the auction is completed or not.
14. OWNERSHIP OF LOOT.
YOU AGREE THAT:
Blizzard owns or has the right to use all of the Loot, as well as all of the characters and content that appears in Diablo.
You do not own any of the Loot, characters, or other content that appears in Diablo, and that you have no right or title in or to any of the Loot (other than any license to use any Loot granted to you by Blizzard, which may be revoked by Blizzard at any time), Diablo, or your Account.
You are not allowed to sell, trade or somehow transfer Loot, characters, or any other Diablo content outside of Diablo or the Auction House.

Don't be confused by the verbiage in paragraph 6B. The 'regardless of whether the auction is completed or not' is irrelevant. Sell LOOT, not LICENSE. Blizzard is the only party with claim over loot. Players have claim over licenses.
They phrase it in this way so that they can sell loot generated without a license (ie. loot that didn't drop by playing the game).
They don't have to tell you if they start, and they NEVER said that they wouldn't.
PR'd. Too much double speak and contractual obligations going on in the gaming industry.

No, it means that:
1) we are all contracted into service upon accepting the rmah ToU
2) the loot is owned by blizzard
3) you are given a contractually binding license to use the loot upon receiving the item under any means

We all spent $60+ for the limit privilege to play Diablo III. None of us as players "own" the game. We only paid to be able to play it and Blizzard can revoke that ability pretty much at anytime. So we don't own the game, we don't own the items and we don't own our gold.
Whatever way we look at it we are just renting the colorful pixels.

Except that with any rental agreement you are entitled to use until the expiry of the agreement or sufficient notice.

I remember back in the day there was a guy called Geoff Frazier that worked for Blizzard who got up to that kind of nonsense in WoW, to the point where he had a Penny Arcade comic made about him. Do they need to sell items to make money? No.
Will they make way more money selling perfect items on the RMAH? Yes.
Free market entities exist to maximize profit. There is no such thing as "enough" money. You make as much as you can from the smallest amount of inputs.

remember, if you don't have a cellphone/sms, have they called "blizzard balance"
basically an imaginary number that you can spend for RMAH or blizzard stuff, so dont assume to gain income from this, blizz still owns your 100 dollars worth of items.
